Misconception Muslim and Thai marriage
There has been often issues regarding marriages being performed in Thailand. Wherein religious ceremonies and civil process are mixed and understood as the same. This has been the common mistake that all have assumed and ended up disappointed when they have gone home. To clarify these, please see below comparison of both, to give you a full and clear picture among the two processes.
Muslim Marriage – Islamic ceremony
Many Muslims have gone to Thailand to marry their Muslim fiancée’s and even non-Muslim ones. They have found Thailand as a place where the process is straightforward and simple which would not involve a lot of requirements from their end. This would be an advantage especially if after the marriage, both will decide to settle abroad in a Muslim country. This marriage will for sure be recognized under Islamic law and couples may then join together permanently abroad.
Most Muslim countries do strictly require a Muslim marriage done, and conversion of non-Muslim party be made so to authorize the joining of couples in their country if married under Islamic law. At the same time, if legally married under civil law, of a foreign country, they will also recognized it as a legal binding, may it be with a Muslim marriage or without. Then, what has it have to do with the Thai marriage?
Thailand Legal Marriage
This process is a legal binding commitment and union among all couples which is recognized all over the world. This is not a religious process nor a ceremony only, but a legal process wherein both you will be as husband and wife.
It would take a longer process and more documentations needed to proceed. A visit to your embassies would be required stating that you are free to marry. The process would be performed and completed at a district office in Thailand. After a lengthy process, it has to be legalized so it can be used from your respective countries abroad. This type of marriage will allow spouses to sponsor your wife to live with you overseas, specifically to Western countries or non-Muslim countries. On the other hand, with this type of marriage, a foreign spouse can move to Thailand and stay permanently with his Thai wife or a foreign wife on a Thai visa. Which you can act as a dependent to your spouse visa.
It is a bit of confusing but one must have to understand the difference between both, so you will know which process you need for your spouses.
