If you are married and your spouse disagrees on having a divorce in Thailand, you will need court intervention. A Thailand divorce lawyer is required for this process. You cannot remarry until the previous marriage is annulled or the divorce has been granted, and you need to show up in court for the proceedings.

A Thailand divorce lawyer will act with your Power Of Attorney (POA) on your behalf undergoing the preliminary proceedings, in cases where the client is outside of the country – wherein you are only required to appear in person on the final hearing; you will not be allowed to have someone acting on your behalf with a power of attorney at the final hearing. Thus, if you are married in Thailand then you should have a divorce in Thailand.

A Thailand divorce lawyer will act with your power of attorney and file it with the Thai court on your behalf in cases when you are overseas. You will only need to send a copy of your passport, marriage certificate, Thai spouse’s national ID copy and any information regarding your marriage, your children and addresses, also some information regarding the breakup including consecutive dates and circumstances when the issue took place.

For marriages held overseas with one party being a Thai national, a divorce in Thailand would only be possible if the marriage was reported at the local district office where the Thai party lives. The divorcing couple could process the divorce at the same district office where the marriage was reported. If the place of marriage is overseas and was not reported in Thailand, you will be required to report the marriage registration at the local district office in Thailand.

A marriage certificate written in Thai is also required, so if the marriage certificate issued is in a foreign language – you will have to get it translated into Thai and legalized at the Ministry of Foreign Affairs to affirm that it is the correct translation. Only will the divorce be allowed to be registered at the same district office if the marriage has been reported to the Amphur where the Thai party resides. Speak to a Thailand divorce lawyer to have a clearer picture of those divorce procedures.
